Chinese government authorities announce second batch of quotas about RE mining and smelting and separation for 2018

Ministry of Natural Resources (MNR) and Ministry of Industry and Information Technology of the People's Republic of China (MIIT) recently released the announcement about China's second batch of rare earth (RE) mining, and smelting and separation quotas for 2018, and details are as follows:
CHINALCO Rare Earth Co., Ltd . , China Minmetals Rare Earth Co . , Ltd . , China Northern Rare Earth (Group) High-tech Co . , Ltd . , Xiamen Tungsten Co . , Ltd . , China Southern Rare Earth Group Co . , Ltd . and Guangdong Rare Earths Industry Group Co . , Ltd.
The second batch of RE mining, and smelting and separation quotas is issued and relevant matters are hereby notified as follows:
1. RE is a product whose mining, smelting and separation are all under strict government administration, and any enterprises and individuals cannot conduct production without plan and beyond plan . 2018 quotas of China's RE mining and smelting and separation are 120,000t and 115,000t respectively.
2. RE company groups should properly break down your own quotas and submit breakdown plans to MIIT, MNR and government authorities of industrial and natural resources in the provinces (regions) within 15 days after receiving our quotas and negotiating with local government authorities of industrial and natural resources.
3. Quotas should be appointed to key enterprises with advanced technical equipment and favorable environment. Any enterprises below cannot obtain the quotas:
1) Miners without mining license, safety production license or out of production for rectification required by relevant government authorities;
2) RE smelting and separation enterprises using poor production processes classified into forbidden or elimination list, and with the capacity lower than 2,000tpy of REO;
3) Enterprises failing to meet the requirements of RE industrial pollutant emission standard;
4) Enterprise out of operation for a long time and without production condition.
4. RE groups should comply with environmental protection and resource development and other regulations, and perform production as planned . Licenseless mining or cross-border mining are banned; businesses of processing for others, including manufacturing consignment, are not allowed; purchasing and processing RE ore on the pretext of RE concentrate, mixed RE compound, etc . are forbidden . Complete import procedures for the utilization of overseas RE resources should be provided.
5. RE groups should not produce without plan or beyond plan . As for illegal enterprises which conduct production beyond plan, buy and process unlawful minerals, pollute the environment, etc . , quotas allocated to them should be cut or canceled . Strictly trace the unlawful minerals' source and fine the illegal enterprises.
6. Relevant government authorities of industrial and natural resources locally should cooperate closely with each other and fulfill the supervision responsibility . Government authorities of industry should further regulate RE production and management order and strengthen inspection; government authorities of natural resources should enhance management of projects on RE resource exploitation and mining and recycle of undeveloped RE ore . Relevant enterprises should truthfully report planned quotas and actual production and management information, and timely upload the data to RE product traceability system to promote the construction of the system.
