Solikamsk Magnesium appeals for review of AD duty

BEIJING (Asian Metal) 7 Apr 06 - On this Thursday, 6th April 2006, major magnesium producer in Russia, Solikamsk Magnesium Works formally appealed the US Department of Commerce with the official request for Administrative Review of the existing anti-dumping duty order against pure and alloyed magnesium from Russia, an official from Solikamsk Magnesium Works told Asian Metal.
The request was submiited in accordance with 19 CFR paragraph 351.213(b) pursuant to the Notice of Opportunity to request an administrative review published in the US Federal Register on 3rd of April 2006.
According to US Antidumping/Countervailing law, any interested party involved into AD/CVD duty investigations have an opportunity to request Administrative Review of existing AD duty.
If, as the result of Administrative Review findings, the US Department of Commerce finds that during the Period of Review AD margin on sales in the US was less than stipulated in original AD duty order, producer or exporter of the product from the country covered by AD duty order will receive back difference between AD duty found by Department in original investigations and AD duty which will be determined by Department during the Period of Review. In contrary, if Department will find that AD duty should be above those found in original investigations for the Period of Review, producer/exporter should pay the difference in budget of the United States .
Administrative Review will cover all US sales of magnesium originated from Solikamsk Magnesium Works during period from 4 October 2004 until 31 March 2006.
Current US anti-dumping duty on pure magnesium from Solikamsk Magnesium Works is 18.65%, which is the lowest, compared with 21 . 71% for JSC AVISMA Titanium-Magnesium Works and 21 . 01% for all other Russian exporters.
