Brazil announces final decision on first anti-dumping sunset review

On October 2, 2019, the Ministry of economy of Brazil issued Order No. 4.434 to make the first affirmative final anti-dumping sunset review on flat rolled low carbon and low alloy thick steel plates originating in China, South Korea, South Africa and Ukraine, and decided to continue to impose anti-dumping duties on the products involved in the above-mentioned countries for five years, among which the products involved in South Africa will not be subject to anti-dumping measures temporarily, and the products involved are under MERCOSUR tax No.7208.51.00 and 7208.52.00; meanwhile, the scope of Taxation for the products involved in the case shall be expanded continuously, with a validity period of 5 years.
On May 3, 2012, Brazil launched an anti-dumping investigation against flat rolled low carbon and low alloy thick steel plates originating in China, South Africa, Australia, South Korea, Russia and Ukraine. On December 6, 2012, Brazil made a negative final anti-dumping judgment on the products involved in Australia and Russia. On October 3, 2013, Brazil made an affirmative final anti-dumping judgment on the products involved in China, South Korea, South Africa and Ukraine, and began to levy anti-dumping duties as follows: China's duty is USD211.56/t, South Korea's duty is USD135.08-135.84/t, South Africa's duty is USD166.63/t and Ukraine's duty is USD261.79/t.
On December 19, 2014, Brazil made the first anti circumvention final judgment on the flat rolled low carbon and low alloy thick steel plates of China and Ukraine: the anti-dumping duty of USD211.56/t is applicable to the thick coated steel plates of China (tax No. 7210.70.10); the anti-dumping duty of USD211.5/t and USD261.79/t is applicable to the boron containing steel plates of China and Ukraine (tax No. 7225.40.90) respectively. On August 31, 2015, Brazil made the second final anti circumvention judgment on China's products involved in the case, and decided to extend the anti-dumping duty of USD211.56/t on China's products involved in the case to chrome plated thick steel plate (tax No. 7225.40.90). On January 27, 2016, Brazil made the third anti circumvention final judgment on China's products involved in the case, expanding the anti-dumping duty of USD211.56/t on China's products involved in the case to conventional or continuously cast low carbon and low alloy flat rolled thick steel coils with width ≥ 600mm and thickness ≥ 4.75mm (tax numbers 7208.36.10, 7208.36.90, 7208.37.00 and 7225.30.00). On August 10, 2016, Brazil conducted the fourth anti circumvention case investigation on the products involved in China. On February 17, 2017, Brazil made a positive final decision on the case and decided to impose an anti-dumping duty of USD211.56/t on China's titanium flat rolled thick steel plate (tax No. 7225.40.90). On October 2, 2018, Brazil launched the first anti-dumping sunset review and filing investigation on flat rolled low carbon and low alloy thick steel plates originating in China, South Korea, Ukraine and South Africa.
