U.S. makes final AD and CVD determinations on steel wheels from China

On March 22, 2019, the Department of Commerce of the U.S. (Commerce) announced its affirmative final determinations in the antidumping duty (AD) and countervailing duty (CVD) investigations of imports of steel wheels from China, assigning a dumping rate of 231.70% to the China-wide entity based on adverse facts available, a CVD rate of 457.10% to Xiamen Sunrise Wheel Group Co., Ltd., Zhejiang Jingu Company Limited, Shanghai Yata Industry Company Limited and all other Chinese producers and exporters. The USITC will announce the final AD and CVD determinations of industry injury on May 6, 2019. Involved steel wheels were under HTSUS codes 8708.70.4530, 8708.70.4560, 8708.70.6030, 8708.70.6060, 8716.90.5045, 8716.90.5059, 4011.20.1015, 4011.20.5020 and 8708.99.4850.
In the AD investigation, the Commerce found that critical circumstances existed for the China-wide entity (including Xiamen Sunrise and Zhejiang Jingu) due to its failure to cooperate. In the CVD investigation, the Commerce found that critical circumstances existed for Xiamen Sunrise and Zhejiang Jingu. Consequently, the Commerce will instruct CBP to impose provisional measures retroactively on entries of steel wheels from China, as applicable, effective 90 days prior to publication of the preliminary determination in the Federal Register.
On April 17, 2018, the Commerce initiated AD and CVD investigations on imports of China's steel wheels in response to the application lodged by Accuride Corporation and Maxion Wheels Akron, LLC on March 27, 2018. On May 10, 2018, the USITC made preliminary AD and CVD determinations of industry injury on steel wheels from China. On August 27, 2018, the Commerce made the preliminary CVD determination and on October 24, 2018, it made the preliminary AD determination. Statistics from the U.S. showed that imports of steel wheels from China were valued at an estimated USD388 million.
