Chinese government authorities announce first batch of quotas about RE mining and separation for 2019

Ministry of Industry and Information Technology (MIIT) and Ministry of Natural Resources (MNR) of the People's Republic of China recently released the announcement about China's first batch of rare earth (RE) mining and separation quotas for 2019, and details are as follows:

The first-batch quotas for 2019 of RE mining and separation are issued and relevant matters are hereby notified as follows:
1. RE is a product of which mining, smelting and separation are all under strict government administration, and any enterprises and individuals cannot conduct production without plan and beyond plan . The first-batch quotas in 2019 of China's RE mining and separation are 60,000t and 57,500t respectively, accounting for 50% of 2018 quotas . The second-batch quotas in 2019 will be assigned before this June.
2. RE companies should properly break down their own quotas and submit breakdown plans to MIIT, MNR and government authorities of industrial and natural resources in the provinces (regions) within 20 days after receiving the quotas . Names of miners in operation and all separation companies in 2019 should be publicized on portal websites.
3. Most quotas should be appointed to key enterprises with advanced technical equipment and favorable environment . Projects for RE resource recycling should be under strict management and proper allocation. Any enterprises in following cases cannot obtain the quotas:
1) Miners without mining license, safety production license, having closed RE resource recycling projects or out of production for rectification required by relevant government authorities;
2) RE smelting and separation enterprises using poor production processes classified into forbidden or elimination list, with the capacity lower than 2,000tpy of REO or out of production for rectification required by relevant government authorities;
3) Enterprises failing to meet the requirements of RE industrial pollutant emission standard and radioactive protection;
4) Enterprises out of operation for a long time and without production condition.
4. RE groups should comply with regulations of environmental protection, resource development and others, and perform production as planned . Licenseless mining or cross-border mining are banned; inter-cooperation processing for each other, including manufacturing consignment, is not allowed; processing RE ore (imported ore included) is forbidden for comprehensive utilization companies . Import procedures for the utilization of overseas RE resources should be complete and data on purchases and consumption should be filled truthfully in RE product traceability system.
5. RE groups should not produce without plan or beyond plan . As for illegal enterprises, which conduct production beyond plan, buy and process unlawful minerals and other behaviors, quotas for next year allocated to their groups should be cut or canceled . Quotas cut or cancelled can be assigned to groups which implement the quotas better.
6. Relevant local government authorities of industrial and natural resources should conduct further cooperation with each other, fulfill the supervision responsibility, check the progress of quota implementation on time, strictly trace the source of lawful minerals and execute punishment according to relevant regulations . Relevant enterprises should truthfully report the progress of planned quotas, timely upload the data to RE product (imported ore included) traceability system and cannot revise data of production and stocks . Enterprises which report false data or conceal data will be publicized and quotas allocated to them will be cut.
Pursuant to the requirements of statistical statement, RE companies should report their data on implemented quotas and production situation of the previous month before the 10th day of each month and they can postpone the date for report in case of holidays. Meanwhile, they should submit data filled into RE product traceability system .
