China revises Law on Prevention and Control of Environment Pollution Caused by Solid Wastes

On 25 June, revised draft of Law on Prevention and Control of Environment Pollution Caused by Solid Wastes was submitted to standing committee of the National People's Congress for review.
Li Ganjie, Minister of Ministry of Ecology and Environment, introduced at the 11th session of the 13th National People's Congress that the existing Law on Prevention and Control of Environment Pollution Caused by Solid Wastes was formulated in 1995 and revised for the first time in 2004. In 2013, 2015 and 2016, amendments on certain articles were made.
The revised draft increases articles to 109 from the existing 91, mainly including improving monitoring and administration mechanism of prevention and control of environment pollution caused by solid wastes, such as establishing credit record system of prevention and control of environment pollution caused by solid wastes, and adding sealing up and detention measures; enhancing prevention and control system for industrial solid waste pollution, such as strengthening responsibilities of industrial solid wastes producers, requiring them to set up and perfect whole-process pollution prevention and control responsibility system, establishing solid waste administration list and verifying qualification and technical competence of consignees that are trusted with transportation, utilization and disposition.
For violations of dumping, piling, dropping and littering industrial solid wastes without authorization and those of dumping and piling hazardous wastes without authorization, the revised draft stipulates strict legal responsibilities. According to new rules, fines will be imposed on a daily and continuous basis and detention can be adopted as an option for violations of removing hazardous wastes without authorization.
