Fujian Office of Land and Resources requires strict inspections on unlicensed rare earth mining activity

The Office of Land and Resources of Fujian province issued a notice on July 25th which stipulated the total mining control index for rare earth mine and tungsten mine and required all departments to strengthen the implementation responsibility system, standardize the recycling of rare earth and strictly investigate and deal with unlicensed rare earth mining activity in accordance with law.
The Office of Land and Resources emphasized that county-levels land resources departments should sign the letter of responsibility with mining enterprises in order to specify clearly rights, obligations and liability for breach of contract; the letter of responsibility should also be reported to provincial and municipal departments for records. In addition, inspections on mining enterprises’ performance control index should be carried out regularly and all departments should timely investigate and deal with violations of laws and regulations, including excessive production, transferring of mining quota indicators, expanding production scale without authorization, not reporting data as required, refusing to be supervised and so on, in accordance with law. At the same time, relevant departments should supervise and urge mining enterprises to establish sound systems which includes the institution of “three charts of one account”, production and sales accounts and original production daily report, etc.
The Office of Land and Resources also stated that the mining and exploitation for rare earth is being protected in China and relevant department shall strictly investigate and deal with unlicensed rare earth mining activity in accordance with law and report all illegal activities to provincial government departments. Besides, those who recycle rare earth resource without authorization on the ground of various engineering construction shall all be deal with as conducting unlicensed mining activity and be shut down.
